概要 | This paper summarizes the symposium "Mixed Legal System and Japanese Law" held at Kyoto on 2 June 2012, on the occasion of the 75th general conference of the Japan Society of Comparative Law. Vernon Palmer (Tulane), Jacques du Plessis (Stellenbosch) and Marius de Waal (Stellenbosch) were invited to discuss with Japanese comparative lawyers the idea of the mixed legal system and its relevance to Japanese law. The author, the organizer of the symposium, thinks that the notion of mixed legal system in the narrower sense, i.e. that of the mixed system of the Civil law and the Common law, can be helpful to understand and analyse Japanese law. She thinks that the notion should be used to analyse laws rather than to classify them. English summary at pages 327‐328. |
